1. Acceptance of Terms

 

Welcome to KidSTAT ("App," "Service," "we," "our," or "us").

These Terms and Conditions ("Terms") govern your access to and use of KidSTAT, including any websites, mobile applications, content, features, and services provided through the platform.

By accessing, downloading, installing, or using KidSTAT, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of the Service

KidSTAT provides educational medical guidance, clinical reference materials, recommended practices, algorithms, and decision-support resources that may assist licensed healthcare professionals in the
evaluation and management of traumatically injured patients.

KidSTAT is intended solely as a clinical reference and educational resource.

The information contained within the App is not intended to replace independent clinical judgment, institutional policies, physician orders, consultation with qualified specialists, or applicable laws and
regulations.

3. Intended Users

KidSTAT is intended for use by:

  • Licensed physicians

  • Advanced practice providers

  • Registered nurses

  • Emergency medical services personnel

  • Respiratory therapists

  • Pharmacists

  • Medical students, residents, fellows, and other healthcare trainees under appropriate supervision

  • Other healthcare professionals involved in trauma care

By using the App, you represent that you are authorized to access healthcare-related educational resources and that your use complies with all laws, regulations, licensing requirements, and institutional
policies applicable to you.

4. Clinical Judgment and Scope of Practice

No Medical Advice

KidSTAT does not provide medical advice, establish a physician-patient relationship, or direct patient care.

All patient care decisions remain the sole responsibility of the treating healthcare professional.

Scope of Practice

Users must provide care only within their:

  • State-approved scope of practice

  • Professional licensure

  • Credentialing privileges

  • Institutional policies and procedures

  • Supervisory requirements

  • Applicable laws and regulations

Nothing in KidSTAT authorizes a user to perform any activity beyond the scope permitted by their license, certifications, organizational policies, or governing laws.

Clinical Responsibility

Healthcare professionals must independently verify all information and determine whether any recommendation is appropriate for the specific patient, clinical situation, available resources, and local
standards of care.

5. No Emergency Reliance

KidSTAT is not intended to function as an emergency communications system or as the sole source of information during patient care.

Users must not rely exclusively on KidSTAT when making clinical decisions.

Appropriate consultation, institutional protocols, and clinical assessment should always be utilized.

6. Independent Resource; No Children's National Affiliation

Although certain clinical content may have been informed by trauma care practices, educational concepts, or publicly available clinical literature, KidSTAT is an independent educational resource.

KidSTAT is not owned, operated, endorsed, sponsored, approved, or officially affiliated with Children's National Hospital, Children's National Medical Center, or any affiliated organization unless expressly
stated in writing.

The inclusion of clinical recommendations, pathways, or educational materials within KidSTAT shall not be interpreted as representing official policies, positions, standards, endorsements, or clinical
guidelines of Children's National Hospital.

Users should consult their own institution's policies, protocols, and leadership when delivering patient care.

7. Accuracy and Updates

We strive to maintain clinically relevant and accurate information; however:

  • Medical knowledge evolves rapidly.

  • Guidelines may change without notice.

  • Clinical recommendations may become outdated.

  • Errors, omissions, or inaccuracies may occur.

We do not warrant that any content will always be complete, accurate, current, or suitable for a particular clinical circumstance.

8. Intellectual Property

All content within KidSTAT, including but not limited to:

  • Software

  • Source code

  • Graphics

  • Images

  • Logos

  • Design elements

  • Algorithms

  • Text

  • Educational materials

  • Clinical pathways

  • Databases

is owned by KidSTAT or its licensors and is protected by applicable intellectual property laws.

Users may not:

  • Copy

  • Reproduce

  • Modify

  • Publish

  • Redistribute

  • Reverse engineer

  • Create derivative works

without prior written permission.

9. User Accounts

If user accounts are offered:

You are responsible for:

  • Maintaining the confidentiality of your credentials

  • Restricting unauthorized access

  • Ensuring information provided is accurate

You agree to notify us promptly of any unauthorized use of your account.

10. Prohibited Uses

Users may not:

  • Use the App for unlawful purposes

  • Upload malicious code

  • Attempt unauthorized access to systems

  • Misrepresent clinical credentials

  • Interfere with operation of the App

  • Use the App to provide care outside lawful scope of practice

  • Rely on the App as a substitute for professional judgment

11. Limitation of Liability

To the fullest extent permitted by law:

KidSTAT and its owners, developers, contributors, authors, advisors, licensors, contractors, and affiliates shall not be liable for:

  • Patient injuries

  • Clinical outcomes

  • Diagnostic errors

  • Treatment decisions

  • Delays in care

  • Medication errors

  • Loss of data

  • Business interruption

  • Indirect, incidental, consequential, or punitive damages

arising from use of, reliance upon, or inability to use the App.

All use of KidSTAT is at the user's own risk.

12. Disclaimer of Warranties

KidSTAT is provided on an "AS IS" and "AS AVAILABLE" basis.

We expressly disclaim all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy

  • Reliability

  • Clinical effectiveness

We make no guarantees regarding uninterrupted operation or error-free performance.

13. Indemnification

You agree to indemnify, defend, and hold harmless KidSTAT and its owners, developers, contributors, contractors, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your use of the App

  • Your patient care activities

  • Violations of these Terms

  • Violations of applicable law or regulations

14. Suspension or Termination

We reserve the right to:

  • Suspend access

  • Restrict functionality

  • Remove content

  • Terminate accounts

at our discretion and without prior notice.

15. Changes to the Service

We may:

  • Modify content

  • Add or remove functionality

  • Change clinical guidance

  • Discontinue portions of the Service

without prior notice.

16. Changes to These Terms

We may update these Terms at any time.

Continued use of KidSTAT following changes constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by the laws of the District of Columbia, United States, without regard to conflict-of-law principles.

Any dispute arising from use of KidSTAT shall be brought exclusively in the courts located in Washington, D.C., unless otherwise required by law.
